These terms govern access to and use of wearebrainwave.co, including its public information, contact and newsletter forms, client-login interface, and public AI assistant. By using the website, you agree to these terms. Separate proposals, statements of work, booking conditions, or client agreements govern paid services and take priority if they conflict with these website terms.

3. Educational and informational purpose

Brainwave communicates science-informed ideas about wellbeing, neuroscience, mental fitness, resilience, sleep, focus, leadership, and workplace performance. Website content and AI-generated responses are provided for general educational and informational purposes. They are not personalised professional advice.

4. Medical and emergency disclaimer

Brainwave is not a medical, psychiatric, psychological, crisis, or emergency service. The website and public assistant do not diagnose, treat, prescribe, or replace advice from a qualified healthcare professional. Do not delay or disregard professional care because of website content or an AI response. If you believe you or another person may be in immediate danger, contact the local emergency services or an appropriate crisis service immediately. Do not submit medical records or sensitive health details through public forms or chat.

5. Services, bookings, and contracts

Descriptions of talks, workshops, consulting, events, or other services are invitations to enquire, not binding offers. A booking or engagement becomes binding only when Brainwave and the relevant client agree the scope, fees, dates, cancellation terms, responsibilities, and any other material conditions in writing. Brainwave may accept, decline, or propose changes to an enquiry. If online payments or direct paid bookings are introduced, separate commercial terms will be presented before purchase.

6. No guarantee of outcomes

Learning, workplace, health, and performance outcomes depend on many factors outside Brainwave's control. Brainwave does not guarantee a particular personal, clinical, organisational, financial, or performance result from using the website, attending an event, or engaging a service.

You may use the website only lawfully and for its intended purpose. You must not:

Any liability connected with paid services is governed primarily by the relevant client agreement.

Brainwave may update these terms to reflect changes in the website, services, or law. The current version and update date will remain on this page. Continued use after an update means the revised terms apply from that point.

If a provision is found invalid or unenforceable, the remaining provisions continue to apply. The invalid provision will be interpreted or replaced as closely as lawfully possible to reflect its intended purpose.

16. Governing law and jurisdiction

These website terms are governed by Swiss law, excluding conflict-of-law rules. Subject to mandatory consumer or other jurisdiction rules, the courts of the Canton of Fribourg, Switzerland, have exclusive jurisdiction.
